The ninth circuit court has maintained a ban on deploying national guard in the Oregon city, following a recent court ruling.

Judicial Panel Concurs to Reconsider Case

The federal appeals court decided on Tuesday that it would rehear the legal dispute concerning the executive power with an expanded panel of eleven justices. The judicial body also overturned a previous decision from a smaller judicial group that had supported the federal government.

Legal Saga Over Troop Deployment

This order represents the latest turn in a protracted court case over whether the administration has the legal right and justification to send state military units in Portland. Approximately 200 federalized guard members have been in uncertainty since late September when the deployment effort was started in due to ongoing demonstrations.

Conflicting Arguments

The federal government has argued that federal officials at the immigration center in the southern part of the city were facing threats, while city and state officials assert that municipal police have control of the situation.

Contrary to characterizations of Portland as a conflict zone, locals have been posting videos of lush hiking trails and a thriving food scene, and organizing events such as an protest bicycle event against the increased military presence.

Recent Legal Actions

The Tuesday ruling came after a US district judge in Portland enacted two legal injunctions this month – one preventing the federalization of the state troops, and another prohibiting the deployment of any military personnel in Oregon, after attempts to evade the first order by calling up out-of-state forces.

On the previous day, the appeals court had temporarily suspended the initial decision – permitting control of 200 Oregon national guard – but the subsequent injunction remained in place, preventing the actual deployment of the forces.

En Banc Review

The Tuesday decision means the issue will be heard by the full court – with both rulings under consideration simultaneously – by a panel of 11 judges.

“This decision demonstrates that facts are important and that the courts are working to ensure government responsibility. The constitution limits the president’s power, and local populations cannot be treated as a training ground for expansive government power,” stated the state attorney general in a official comment.

“The judicial body is sending a definite signal: the president cannot dispatch the armed forces into US cities unnecessarily. We will continue protecting state legislation, values, and sovereignty as this legal proceeding progresses and our fight continues in the judicial system.”
